The Aussie backyard barbecue is the countries most favourite pastime in Australia with family and friends and is now under fire in legal action.
On Australia day and most other times of the year, it’s every Australian’s right to fire up the BBQ and enjoy fun times, that is until a Perth woman has tried to take her neighbour to court for cooking barbecues in their own backyard.
Cilla Carden, who is a vegan from Girrawheen, in Perth’s northern suburbs has taken her next door neighbour to the State Administrative Tribunal and than the Supreme Court, claiming she is fed up with the smell of the barbecue next door when they are cooking meat.
Ms Carden is also angry about cigarette smoke wafting into her yard and the children playing with basketballs next door, claiming that the neighbour’s actions are deliberate.
The State Administrative Tribunal and Supreme Court Judge have both dismissed the cases, Ms Carden’s request to appeal the decisions has also been refused by the courts.
It has been reported that Ms Carden claims that she will not give up on her legal fight and will return to court soon.
While it’s every Australian’s right to eat how you want too, eat meat or not to eat meat, be a vegan or not. When does another person have the right to tell people what they can cook in Australia.
Where as a country do we draw the line on allowing people to take people to court, meanwhile this case has the possibly of going all the way to the Australia High Court over having a BBQ in your own backyard.
